Terms and Conditions

Introduction
These Terms and Conditions (“Terms”) govern the relationship between The Curious Suitcase (“we,” “our,” or “Agency”) and you, the purchaser or traveler (“you,” “your,” or “Client”). By accessing our website, engaging our services, planning travel, or making a booking with The Curious Suitcase, you agree to be bound by these Terms on behalf of yourself and all members of your traveling party. You acknowledge and accept that The Curious Suitcase acts solely as a booking agent for disclosed principal travel suppliers, including but not limited to tour operators, cruise lines, hotels, airlines, ground transportation providers, and other independent contractors (“Suppliers”, “Supplier”). The Curious Suitcase is not the source or provider of travel services and does not control Supplier operations, policies, or performance. These Terms contain legal provisions including warranties, disclaimers, exclusions of liability, and dispute resolution terms that may restrict your rights and remedies and provide protection to The Curious Suitcase. Seller of Travel Information: The Curious Suitcase is an independent affiliate of A.S.A.P. Cruises Inc. Use of Services and Privacy Policy
By using The Curious Suitcase’s services, you confirm, represent, and warrant that you are at least 18 years old and have the legal authority and competency to enter into this agreement and make travel bookings with The Curious Suitcase. You understand and accept that you are financially responsible for all travel bookings made through The Curious Suitcase, whether for yourself or on behalf of others in your travel party.
You warrant that all information provided on behalf of yourself or other travelers in your party, is accurate, complete, and truthful. You further confirm that you have the authority to share personal, medical, or dietary information for all travelers included in your booking. You further agree to make only legitimate reservations and purchases, and understand that speculative, false, or fraudulent bookings are strictly prohibited. The Curious Suitcase acts solely as a booking agent for the Suppliers listed in your itinerary. Each Supplier has its own terms and conditions, and by booking through The Curious Suitcase, you agree to abide by those terms. The Curious Suitcase is not responsible for any independently arranged travel, including associated costs, fees, cancellations, or itinerary changes, and cannot provide assistance with arrangements not booked through the Agency. You acknowledge that you have read, understood, and accepted these Terms and Conditions.
You consent to the collection, use, storage, and processing of personal data in accordance with our Privacy Policy and applicable data protection laws. Personal data is collected for purposes such as booking arrangements, payment processing, communications, and compliance with legal obligations, and may be shared with Suppliers as necessary to provide services. The Curious Suitcase is not responsible for the privacy practices of third parties or the Suppliers. Subject to applicable legal restrictions, clients may request access to, correction of, or deletion of their personal data. The Agency’s Privacy Policy is incorporated into these Terms by reference, and clients consent to the cross-border transfer of personal data where required to facilitate travel arrangements.
Scope of Services
The Curious Suitcase provides professional travel planning, booking, and coordination services, including reservations for air, hotel, transportation, tours, and other travel-related services as requested by the Client. The Agency acts solely as an intermediary between the Client and independent third-party suppliers of travel services (“Suppliers”), including airlines, hotels, cruise lines, car rental companies, tour operators, and insurance providers.
All travel services are subject to the terms, policies, and availability of the applicable Suppliers, and the Agency does not control Supplier operations, pricing, availability, or performance. Availability and pricing are not guaranteed. Quotes, estimates, and holds do not constitute confirmed bookings, and the Agency cannot ensure that requested travel arrangements will be available or that pricing will remain unchanged. Any confirmed reservation remains subject to Supplier terms and conditions.
Information provided by the Agency is for guidance only, and the Agency does not guarantee accuracy, completeness, or timeliness. The Agency does not provide legal, medical, insurance, visa, immigration, security, or financial advice, and recommendations to third-party service providers are for convenience only. The Agency’s duties are strictly limited to the services expressly stated in this Agreement, and no fiduciary, supervisory, or heightened duty of care is implied.
Services are provided primarily electronically, and the Client is responsible for maintaining access and reviewing correspondence in a timely manner. The Agency may correct inadvertent errors in quotes, confirmations, or documentation, and the Client agrees not to hold the Agency liable for typographical or clerical mistakes. Unless specifically contracted, the Agency is not obligated to proactively monitor or notify Clients of schedule changes, Supplier insolvency, labor disputes, weather, strikes, travel advisories, or other events.
Suppliers and third-party providers are independent contractors, and the Agency is not liable for their acts or omissions.
Payments, Changes, Cancellation, and Refunds
All travel bookings are subject to Supplier availability and confirmation. To confirm any reservation, you must pay the required deposit or full payment as specified in your invoice. Final payments must be received by the deadline shown on your invoice. If final payment is not received by the due date, The Curious Suitcase reserves the right to cancel your reservation and retain all deposits and fees paid. You are responsible for all deposits, balances, fees, taxes, and assessments, including Supplier penalties for changes or cancellations.
Agency service fees are non-refundable once paid, except where required by law or expressly stated in writing. Supplier fees and charges are governed by the applicable Supplier’s terms and conditions and may be non-refundable, partially refundable, or refundable. Any refunds issued are subject to Supplier policies and will be provided only in the form and timeframe specified by the Supplier.
You authorize The Curious Suitcase to charge your payment method for any amounts due, including but not limited to deposits, final payments, Supplier fees, administrative fees, change fees, and any amounts required to correct errors or to complete your booking. You acknowledge that payment processing may involve third-party systems and may be subject to exchange rate fluctuations and foreign transaction fees, which are your responsibility.
Chargebacks are strictly prohibited except in cases of confirmed, documented fraud. Except for documented fraud or unauthorized charges, chargebacks are prohibited. If you dispute a charge, initiate a chargeback, reversal, or reversal request, or otherwise seek to recover payment without first following the dispute resolution process set forth in these Terms, you will be in material breach of this Agreement. In such an event, The Curious Suitcase may immediately suspend all services, cancel all future travel arrangements, and pursue all legal remedies available. You agree to reimburse The Curious Suitcase for all costs and expenses incurred in defending against any chargeback or payment dispute, including administrative fees, collection costs, and reasonable attorneys’ fees, regardless of the outcome. If a chargeback is reversed in The Curious Suitcase’s favor, you authorize The Curious Suitcase to re-bill your payment method for the disputed amount, including any associated fees, and you agree to pay such amount immediately. You further acknowledge that any Supplier-issued credits are the sole remedy available where permitted by Supplier policies.
Client Responsibilities & Travel Documentation
You are responsible for reviewing all itinerary details, confirmations, invoices, and travel documents promptly upon receipt and for notifying The Curious Suitcase immediately of any errors or discrepancies. You must report any discrepancies within twenty-four (24) hours of receipt. If you fail to notify The Curious Suitcase within 24 hours, you agree that The Curious Suitcase is not responsible for any costs associated with correcting those errors and that any associated Supplier penalties will be your responsibility.
You are responsible for obtaining and carrying a valid passport, required visas, and any other travel documents necessary for your destination and any transit countries. Passports must be valid for at least six (6) months beyond your return date unless otherwise specified by the destination country. You are also responsible for obtaining any required vaccinations or medical documentation, and non-U.S. citizens must inform The Curious Suitcase if traveling on a non-U.S. passport. The Curious Suitcase does not control or guarantee visa issuance or visa waiver approvals and is not responsible for any losses resulting from failure to obtain proper documentation. Entry and exit regulations can change at any time, and you are responsible for complying with current rules. Any resulting costs, delays, or denied entry are your sole responsibility.
You must comply with all airline, airport, and Supplier rules, including check-in times, baggage requirements, boarding procedures, and cancellation rules. You are responsible for arriving at the airport or departure location with sufficient time to complete check-in and security procedures, including TSA requirements. You must not carry hazardous, restricted, or prohibited items, and you are responsible for any penalties, fines, confiscations, or delays resulting from violations.
You must disclose any medical conditions, disabilities, or dietary needs prior to booking and ensure that you carry all necessary medications, equipment, and documentation. You must behave responsibly and comply with all laws and Supplier rules. You are responsible for maintaining current emergency contact information and ensuring that all members of your travel party understand and follow these Terms. Failure to comply with these responsibilities may result in denied boarding, cancellation, or additional charges, all of which will be your responsibility.
You are strongly encouraged to purchase adequate travel insurance and may be required to complete an insurance acceptance or declination form. If you decline insurance, you accept full financial responsibility for all costs, losses, or penalties arising from cancellation, interruption, medical emergencies, or other travel-related issues. The Curious Suitcase will not be responsible for any losses or expenses that would otherwise be covered by travel insurance.
You are responsible for ensuring that minors have the required travel documents and parental consent forms, if applicable. You must also provide any custody documents, consent letters, or special visas needed for minors traveling with only one parent or with guardians. The Curious Suitcase is not responsible for any delays, denied boarding, or costs resulting from incomplete or improper documentation.
You are responsible for monitoring travel advisories, safety conditions, and changes to travel requirements and for making decisions based on your own risk tolerance. You acknowledge that travel involves risks such as delays, accidents, illness, property damage, and natural disasters, and you voluntarily assume those risks. The Curious Suitcase is not responsible for any losses resulting from travel risks, including but not limited to cancellations, delays, or interruptions.
Air Travel
Airline tickets and air transportation services are provided solely by independent air carriers and constitute a contract exclusively between the Client and the applicable airline, even when purchased through The Curious Suitcase. The Curious Suitcase does not own, operate, manage, or control any airline and acts only as an intermediary in the sale of airline tickets. The Curious Suitcase is not responsible or liable for any personal injury, property damage, death, delay, inconvenience, loss, expense, or other issue arising from or related to air travel, including but not limited to airline schedule changes, cancellations, delays, overbooking, denied boarding, aircraft substitutions, seat assignments, fare rules, baggage policies or fees, frequent flyer programs, airline insolvency or bankruptcy, or cessation of operations.
Airlines retain full authority and discretion over flight schedules, routing, aircraft type, seat assignments, boarding procedures, baggage allowances, and compliance with all applicable laws and regulations. Seat assignments are not guaranteed, even when requested or confirmed in advance, and The Curious Suitcase has no control over seating availability or airline operational decisions. The Agency does not guarantee on-time departures or arrivals, specific aircraft, routing, or seating arrangements.
Clients are responsible for receiving, reviewing, verifying, and safeguarding all electronic tickets (“e-tickets”) and airline travel documentation immediately upon issuance. Any discrepancies must be reported promptly to The Curious Suitcase. Once tickets are issued in accordance with airline rules, The Agency is not liable for errors, omissions, loss, misuse, or theft of e-tickets or related documentation.
Clients are strongly advised to reconfirm flight schedules directly with the airline prior to departure and to comply with all airline check-in and boarding requirements. Failure to comply with airline rules, check-in deadlines, boarding procedures, or documentation requirements may result in denied boarding, missed flights, or additional costs, all of which are the sole responsibility of the Client. The Curious Suitcase is not responsible for any resulting losses, missed connections, or downstream travel disruptions, including cruises, tours, or accommodations.
Clients acknowledge that air travel involves inherent risks, including mechanical issues, weather conditions, security requirements, operational disruptions, and other unforeseen circumstances beyond the Agency’s control. By booking air travel through The Curious Suitcase, Clients voluntarily assume all risks associated with air transportation and agree that all airlines and related Suppliers retain exclusive responsibility for their operations and services.
Travel Insurance
The Curious Suitcase strongly recommends that Clients purchase travel insurance to help protect against unforeseen events, including but not limited to trip cancellation or interruption, medical emergencies, emergency evacuation, pandemics, lost or delayed luggage, supplier insolvency, and other travel-related risks. Unless expressly stated otherwise, travel insurance is not included in the cost of any itinerary or booking, and an additional charge will apply if travel insurance is purchased.
The Curious Suitcase is not a licensed insurance broker or insurer and does not provide insurance advice, legal advice, or guarantees regarding coverage, benefits, exclusions, conditions, or claim outcomes. Any insurance recommendations are provided for convenience only. Clients are solely responsible for reviewing all insurance policy terms, limitations, exclusions, and conditions directly with the insurance provider and for determining whether coverage is adequate for their specific travel plans, activities, and personal circumstances. The Curious Suitcase makes no representations or warranties regarding the acceptance, approval, or payment of any insurance claim.
The purchase of travel insurance is not required to purchase any product or service offered by The Curious Suitcase unless expressly required by a Supplier or carrier. Clients who decline to purchase travel insurance may be required to execute a written insurance waiver acknowledging such declination. Clients acknowledge that by opting not to purchase travel insurance, cancellation, interruption, delays, changes, illness, injury, supplier default, or other unforeseen events may result in penalties, non-refundable costs, or the loss of funds up to the full cost of the travel booking, including amounts paid to The Curious Suitcase and travel Suppliers.
Clients who choose to travel without insurance voluntarily assume all risks associated with travel and accept full financial responsibility for all medical expenses, emergency treatment, evacuation, repatriation, cancellations, delays, interruptions, losses, damages, or expenses of any kind. The Curious Suitcase shall have no responsibility or liability for any costs, losses, or damages that would otherwise be covered by travel insurance.
Risks, Safety, and Special Travel
Travel involves inherent risks, and certain destinations, itineraries, or activities may present greater risks than others. The Curious Suitcase strongly encourages Clients to remain informed about current events, safety conditions, health risks, entry requirements, and travel advisories issued by the United States Government and other relevant authorities before and during travel. By offering or arranging travel to any destination, The Curious Suitcase does not represent or warrant that travel to such destination is advisable, safe, or without risk, and shall not be responsible for any injuries, losses, damages, costs, or expenses arising from travel to or within such destinations.
Clients are solely responsible for monitoring travel advisories, warnings, restrictions, and safety conditions applicable to their itinerary, including those related to political instability, public health, environmental hazards, crime, terrorism, civil unrest, or governmental actions. The Curious Suitcase is not responsible for the actions, decisions, or requirements of foreign governments, border authorities, law enforcement agencies, airlines, or other Suppliers, including denied entry, refusal of boarding, detention, quarantine, evacuation orders, or changes in travel conditions. Any resulting costs, delays, losses, or expenses are the sole responsibility of the Client.
Clients acknowledge that travel may involve inherent and unforeseeable risks, including but not limited to illness, injury, accidents, medical emergencies, theft, property damage, transportation disruptions, supplier failures, natural disasters, pandemics, public health emergencies, political instability, terrorism, war, or acts of government. Clients knowingly, voluntarily, and expressly assume all such risks and agree that The Curious Suitcase shall not be liable for any resulting injury, loss, damage, delay, inconvenience, expense, or disruption.
Certain types of travel and activities, including but not limited to adventure travel, safaris, diving, snorkeling, mountaineering, hiking, wildlife encounters, travel to remote or underdeveloped areas, high-altitude destinations, or travel to politically unstable or sanctioned regions, involve heightened risks and limited access to medical care, evacuation services, infrastructure, or emergency assistance. Clients acknowledge and accept all such heightened risks and agree that The Curious Suitcase has no duty to assess, evaluate, monitor, or warn of the safety, suitability, or risk level of any destination, activity, accommodation, or Supplier, nor any obligation to provide evacuation, rescue, medical assistance, or alternative arrangements.
In the event of emergencies, including but not limited to natural disasters, political unrest, health emergencies, labor strikes, or security incidents, The Curious Suitcase is not responsible for evacuation, medical treatment, repatriation, alternative accommodations, or additional transportation. Clients are solely responsible for any related costs and must rely on travel insurance or make payment directly to Suppliers. While travel insurance may mitigate certain risks, The Curious Suitcase makes no guarantees regarding coverage or claim approval.
For U.S. citizens traveling internationally, enrollment in the Smart Traveler Enrollment Program (STEP), a free service offered by the U.S. Department of State, is strongly recommended. Enrollment and compliance with any guidance provided through such programs remain the sole responsibility of the Client. Any safety or destination information provided by the Agency is general in nature, based on publicly available sources, and does not constitute a guarantee, representation, or assurance of safety.
Responsibility, Liability, and Force Majeure
The Curious Suitcase acts solely as a booking agent and intermediary for independent third-party travel suppliers, including but not limited to airlines, hotels, cruise lines, tour operators, transportation providers, and insurance providers (“Suppliers”), and does not own, operate, manage, or control any Supplier or the services provided by any Supplier. Clients acknowledge and agree that travel services are provided by the applicable Supplier identified in the Client’s travel documentation, and that The Curious Suitcase is not the source or provider of any travel services. The Force Majeure event must be beyond the reasonable control of The Curious Suitcase, unforeseeable, and not due to the negligence or fault of the Agency. Accordingly, The Curious Suitcase shall not be liable for any injury, death, loss, damage, delay, inconvenience, expense, or other issue arising from or related to any act or omission of any Supplier, including but not limited to failures in performance, changes to itineraries, cancellations, overbooking, service interruptions, or Supplier insolvency.
The Curious Suitcase shall not be responsible for any loss, damage, injury, delay, or expense resulting from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, extreme weather, earthquakes, fires, floods, epidemics, pandemics, public health emergencies, quarantines, acts of war or terrorism, civil unrest, labor disputes or strikes, governmental actions or omissions, changes in laws or regulations, transportation failures, equipment malfunctions, or failures of utilities, communication systems, web hosts, or internet service providers (“Force Majeure Events”). In the event of a Force Majeure Event, any Supplier may, at its sole discretion, cancel, delay, modify, substitute, or suspend any portion of the travel arrangements, and any refunds, credits, or remedies shall be governed solely by the applicable Supplier’s terms and conditions.
In the event of a Force Majeure Event, The Curious Suitcase’s role is strictly limited to providing reasonable assistance in rescheduling or arranging alternative services only as permitted by the applicable Supplier’s terms and conditions. The Curious Suitcase shall not be responsible for any additional costs, losses, damages, or expenses arising from such events, including but not limited to accommodations, meals, transportation, medical care, evacuation, or repatriation. Clients acknowledge and agree that all such costs are the sole responsibility of the Client and must be paid directly to the applicable Suppliers.
Clients acknowledge that travel insurance may provide coverage for certain losses or expenses arising from Force Majeure Events; however, The Curious Suitcase makes no representations or warranties regarding insurance coverage, availability, or claim approval, and shall have no liability for any costs, losses, or expenses not covered by insurance or recoverable from Suppliers.
Limitation of Liability
To the fullest extent permitted by applicable law, The Curious Suitcase and its directors, officers, employees, agents, affiliates, suppliers, licensors, and service providers shall not be liable for any losses, damages, or expenses of any kind, whether direct, indirect, incidental, consequential, special, punitive, or exemplary, including but not limited to loss of profits, loss of revenue, loss of data, loss of use, or any other economic loss arising out of or related to: (i) your use of this website or services; (ii) any travel arrangements booked through The Curious Suitcase; (iii) any acts or omissions of Suppliers; (iv) delays, cancellations, or changes by Suppliers; (v) any Force Majeure event; or (vi) any other matter arising under or in connection with these Terms, whether based on contract, tort (including negligence), strict liability, or any other legal theory. This limitation does not apply to damages resulting from gross negligence, willful misconduct, or fraud.
In no event shall The Curious Suitcase’s total liability exceed the total amount paid by you to The Curious Suitcase for the travel services giving rise to the claim. This limitation applies even if The Curious Suitcase has been advised of the possibility of such damages.
Complaints and Problem Resolution
Clients must promptly report any problems, service issues, or dissatisfaction directly to the applicable travel Supplier at the time the issue arises, including but not limited to airlines, airports, hotels, resorts, cruise lines, tour operators, ground transportation providers, transfer services, excursion providers, and other third-party service providers involved in the Client’s itinerary. Many issues can only be resolved while travel is in progress, and failure to raise concerns immediately with the appropriate Supplier may limit or eliminate any available remedies.
Clients must also notify The Curious Suitcase as soon as reasonably possible of any significant issues affecting their travel so that the Agency may, at its discretion, attempt to assist in communicating with the applicable Supplier. The Curious Suitcase does not guarantee any specific outcome and is not responsible for Supplier decisions, responses, or resolutions.
Any formal written complaint must be submitted to The Curious Suitcase within fourteen (14) days of the Client’s return from travel and must include relevant documentation supporting the claim, including receipts, confirmations, photographs, and correspondence with the Supplier. The Agency may, at its sole discretion, decline to review or pursue complaints submitted outside this timeframe or lacking adequate documentation.
Any refunds, credits, reimbursements, or other remedies are subject solely to the terms, conditions, and discretion of the applicable Supplier. The Curious Suitcase shall not be liable for any Supplier decision, denial, or failure to provide compensation. To the extent the Agency assists with complaint submissions or follow-up, such assistance is provided as a courtesy only and does not create any obligation or guarantee of resolution. Any chargeback, reversal, or payment dispute is governed exclusively by the payments, changes, cancellation, and refunds section of these terms.
Governing Law, Dispute Resolution, and Changes to Terms
Changes to Terms. The Curious Suitcase may modify these Terms at any time in its sole discretion. Any changes will be effective immediately upon posting on the Agency’s website or otherwise providing notice. It is your responsibility to review these Terms periodically. Your continued use of The Curious Suitcase’s services after any changes are posted constitutes acceptance of the updated Terms. Changes will not apply retroactively to bookings already confirmed unless required by law or Supplier terms. If there is any inconsistency between versions, the most current version shall govern.
Governing Law and Venue. These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of laws principles. You agree that any legal action or proceeding arising out of or related to these Terms, your booking, or your travel will be brought exclusively in the state or federal courts located in Ohio. You expressly consent to the exclusive jurisdiction and venue of those courts.
Dispute Resolution. Prior to initiating any legal action, the parties agree to attempt to resolve disputes in good faith through direct negotiation. If negotiation fails, either party may pursue any available legal remedies in the Ohio courts. The prevailing party shall be entitled to recover reasonable attorneys’ fees, costs, and expenses.
Time Limit to File Claims. Any claims must be filed within twelve (12) months following the completion date of the trip.
Damages. The Curious Suitcase shall not be liable for any damages other than compensatory damages, and Clients waive any right to seek punitive or exemplary damages.
Disclaimers
The Curious Suitcase provides travel planning and booking services and makes no representations or warranties regarding the accuracy, completeness, timeliness, or suitability of any information provided on our website or through our services. All content, materials, products, and services offered on or through this website are provided “AS IS,” “AS AVAILABLE,” and without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, The Curious Suitcase and its directors, officers, employees, agents, affiliates, licensors, and service providers disclaim all warranties, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that any information provided will meet your specific requirements, that any errors or defects will be corrected, that the website will operate securely or without interruption, or that the website or any communications sent through it will be free of viruses, malware, or other harmful components.
The Curious Suitcase does not guarantee the accuracy, completeness, or currency of any content on this website, and you are responsible for verifying all information and confirming bookings directly with Suppliers. The website may include user-generated content, third-party links, or promotional material for products or services not provided by The Curious Suitcase. We do not endorse, guarantee, or assume responsibility for any third-party content or services, including the accuracy, reliability, or legality of such content or services, and any reliance you place on such content is strictly at your own risk. We do not guarantee the delivery, receipt, or storage of communications, messages, travel documents, or personalized settings, and you are responsible for maintaining backup copies of any important information and protecting your devices from viruses and malware.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you to the extent prohibited by applicable law.
Severability
If any provision of these Terms and Conditions is held by a court of competent jurisdiction to be contrary to law, such provision will be changed and interpreted so as to best accomplish the objectives of the original provision to the fullest extent allowed by law and the remaining provisions of these Terms of Use will remain in full force and effect.
Acknowledgment And Consent
Electronic signatures, initials, checkboxes, or other forms of electronic acknowledgment are binding and enforceable. By signing or otherwise electronically acknowledging these Terms and Conditions, you confirm that you have read, understood, and agree to be bound by all provisions herein on behalf of yourself and all members of your travel party. You acknowledge that these Terms constitute the entire agreement between you and The Curious Suitcase regarding travel services, superseding all prior agreements, representations, or communications. You further acknowledge and agree that you have had the opportunity to ask questions, seek independent legal advice, and that you voluntarily accept all terms, including but not limited to limitations of liability, arbitration, non-refundable fees, and the Supplier terms incorporated herein by reference.
You expressly consent to the Agency collecting, storing, and processing your personal data as described in these Terms and the Privacy Policy. You also consent to receiving communications, including travel notifications, updates, and any required legal notices, through electronic means.
By signing or electronically acknowledging these Terms, you also acknowledge that the Agency has the right to enforce these Terms, including seeking collection of unpaid balances, legal fees, and damages, and you waive any claims that may contradict or invalidate the enforceability of these Terms.
